Post Decree Modification of Spousal Support
While a divorce case is pending, a court has the power to dissolve the parties' marriage, to resolve issues of child custody and child support, to divide the parties' debts and liabilities and to order the payment of spousal support. The court has the power to take these actions because it has jurisdiction over the parties and the subject matter. Once a final divorce decree is entered, the case terminates.
Juvenile Litigation with Respect to Institutional Confinement Facilities
There are many juveniles that are confined to public and private institutions. Many of the institutions have deplorable conditions. Juveniles are often held in dingy cells or small, dark rooms and are confined for hours, days, or weeks. Often times juveniles are deprived of exercise, recreational activities and schooling. Sometimes juveniles are even supervised by untrained or inadequate staff as well.
Child Support and the Military
Enforcement of child support with respect to active military personnel is different than that of enforcement of civilian child support. First and foremost, locating the military individual can be difficult.
Same-Sex Marriages
A same-sex marriage is defined as a marriage between two individuals of the same gender. The issue of same-sex marriages is a hotly debated topic. In the most recent election in the United States, more than ten states voted to amend their state constitution's and define a marriage as a union between a man and a woman. Most other nations do not recognize same-sex marriages as legally valid, nor do they allow them to occur.
Child Custody and Religion
Religion is usually not an issue in child custody proceedings, even if the parents practice different religions. For example, if a child has a Christian mother and a Jewish father, a court will not consider the merits of either religion in determining which parent should have custody of the child. The court will grant custody to one parent, or joint custody to both parents, and the child will be exposed to both the mother's religion and the father's religion.
